Terms of Service

Welcome to OwnTheMoon ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the website ownthemoon.net and any related services (the "Service"), and your purchase of a digital moon piece ("Moon Piece"). By using the Service or purchasing a Moon Piece, you agree to these Terms.

1. Digital Product

A Moon Piece is a unique digital collectible representing a symbolic claim to one numbered tile of a digital representation of the Moon. The Moon Piece consists of a public listing on OwnTheMoon, a personalized certificate, and shareable digital assets. It is a digital product only.

2. Ownership of Your Moon Piece

Once your payment is successfully processed, the Moon Piece is permanently reserved for you. Your ownership of the Moon Piece is intended to be permanent for the lifetime of the Service, subject to these Terms. You may share your certificate, public page and social images freely.

3. No Ownership of the Actual Moon

You expressly acknowledge that OwnTheMoon does not sell, transfer, or grant any real-world legal, physical, extraterrestrial, or celestial rights to the actual Moon or any portion of it. The Outer Space Treaty of 1967 prohibits national appropriation of celestial bodies. Your Moon Piece is a symbolic digital collectible and does not confer any real-world property rights.

4. User-Generated Messages

You may add a personal message to your Moon Piece. You are solely responsible for the content you submit. By submitting a message you grant us a worldwide, royalty-free, non-exclusive license to display, host, and distribute that message as part of the Service.

5. Prohibited Content

You may not submit content that:

• Is unlawful, hateful, harassing, defamatory or threatening;
• Infringes third-party intellectual property or privacy rights;
• Contains sexually explicit material, or material harmful to minors;
• Contains spam, malware, phishing links or advertising;
• Impersonates any person or entity.

We reserve the right, at our sole discretion, to remove or redact any content that violates these Terms, without refund.

6. Intellectual Property

The Service, including the OwnTheMoon name, logo, design, software, moon imagery and generated assets, is owned by us and protected by applicable intellectual property laws. You retain rights to the text of your personal message. Your certificate and share images are licensed to you for personal, non-commercial use.

7. Payments

Payments are processed by Stripe. By purchasing a Moon Piece you agree to Stripe's terms. Prices are shown in the currency displayed at checkout and include applicable taxes where required.

8. Refunds

Because each Moon Piece is a unique digital collectible permanently reserved on purchase, sales are generally final. See our Refund Policy.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, OwnTheMoon shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate access to any user who violates these Terms. In the event OwnTheMoon ceases operation, we will use reasonable efforts to make your certificate and Moon Piece assets available for download.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which OwnTheMoon is established, without regard to conflict-of-law principles. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of that jurisdiction, unless mandatory consumer law grants you additional rights.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Material changes will be communicated on the site.
